Heard Shri Vivek Saran, learned counsel for the petitioner, Ms. Usha Kiran, learned counsel for respondent no. 4 and learned Standing Counsel for the State - respondents.
The husband of the petitioner died on account of electrocution attributable to the alleged negligent conduct of respondent nos. 2 to 4. It is not disputed that the petitioner has been awarded an ad hoc compensation by the Power Corporation to the tune of Rs. 1 lac and Rs. 30,000/- by the District Magistrate, Etah. She prays for additional compensation to the tune of Rs. 10 lacs with 9% interest.
When we confronted learned counsel for the petitioner as to under what provision of law is the petitioner entitled to enhanced compensation, he placed reliance on a judgement of this Court in Yash Pal Singh (Minor) and another Vs. State of U.P. and others, reported in 2017 (5) ADJ 696; wherein, it appears that on the facts and circumstances of the case, enhanced compensation was awarded. Thus, the said judgement would not have any binding effect as no law has been propounded therein.
No other plea is urged.
The writ petition is dismissed as not maintainable.
