The petitioner seeks for quashment of C.C.No.131 of 2013 on the file of the Special Mobile Judicial First Class Magistrate, Machilipatnam. The allegations are made under Sections 498-A and 323 read with Section 34 of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act. The petitioner is A.4. She is the sister of the mother-in-law of the first respondent.
The learned counsel for the petitioner submitted that there are no allegations against the petitioner.
Section 161 Cr.P.C. statement itself shows specific allegations against the petitioner. I, therefore, do not consider it appropriate to quash C.C.No.131 of 2013.
If the allegations are false, the petitioner may defend her case before the trial Court. I see no merits in this Criminal Petition.
The Criminal Petition is accordingly dismissed. Miscellaneous Petitions, if any pending in this Criminal Petition, shall stand closed.
