JUDGMENT / ORDER

Heard learned counsel for the petitioner, learned standing counsel for opposite parties no. 1, 2, 3 and 4 and Sri H.S. Jain for opposite party no. 5, who pray for and is allowed four weeks' time to file counter affidavit. Rejoinder affidavit may be filed within a week, thereafter.
Issue notice to opposite parties nos. 6 and 7 returnable at an early date.
Sri H.S. Jain has pointed out that vide Annexure No. 1, regularly selected candidate has come to join in the college. The petitioner was appointed on Ad-hoc basis. It is needless to say that an Ad-hoc teacher does not have any right after the regularly selected candidate comes. It has been seen that on one hand the committee of management makes appoinment on ad-hoc basis, on the pretext that his students are suffering and they may be allowed to appoint teachers in the interests of students till regularly selected candidates come but once regularly selected candidates come, the committee of management in connivance with the ad-hoc teachers starts obstructing the joining of the regularly selected candidates. The Court does not appreciate this attitude.
In view of the above, this Court directs the committee of management as well as the District Inspector of Schools to ensure the joining of the selected candidate.
