Heard learned counsel for the petitioner, learned A.G.A. and learned counsel for the opposite party Nos.4 & 5 and perused the record.
In compliance of the order dated 4.11.2015 passed by this court, the detenue Neelam Sharma has been produced before this court by opposite party Nos.4 & 5 (father and mother of the detenue). The detenue Neelam Sharma has been identified by learned counsel for the petitioner as well as learned counsel for opposite party Nos.4 & 5 and by the husband of the detenue.
On being query made by the court, the detenue Neelam Sharma states that her marriage was solemnized with Manish Kumar on 22.02.2014. She further states that at present she is living with her parents (opposite party Nos.4 & 5). She has clearly stated that she was ousted by her husband due to which she is living with her parents on her own sweet will. She has not been illegally detained by her parents. She further states that she is major and her age is about 26 years. The detenue Neelam Sharma has clearly stated that she is not in illegal detention of opposite party Nos. 4 & 5 or anyone.
In view of the statement of Neelam Sharma, this Habeas Corpus Petition fails and is accordingly dismissed. The bank draft of Rs.10,000/- deposited in the name of detenue Neelam Sharma be handed over to her.
