Heard the learned counsel for the applicants and the learned AGA appearing on behalf of the State.
This application has been filed under Section 482 CrPC seeking a direction to the Principal Judge, Family Court, Moradabad to decide the proceeding of Case no.227 of 2005, Neelam Saxena vs. Rajendra Singh, under Section 125 Cr.P.C. within a stipulated period of time as fixed by this Court.
The submission of the learned counsel for the applicants is that an application has been filed by applicant no.1 under Section 125 CrPC seeking award of maintenance against opposite party no.2, her husband that is pending before the Principal Judge, Family Court, Moradabad since the year 2005. She has no means of sustenance and is suffering irreparable hardship due to non-determination of her case with expedition.
Considering the aforesaid facts and circumstances, the Judge, Family Court concerned is directed to expedite proceedings and conclude the same as far as possible within a period of eight months next from the date of receipt of a certified copy of this order without granting any unnecessary adjournment. In case an application for interim maintenance is pending or is filed, the same shall be disposed of within a period of one month next from the date that it is filed, and, if already on record, from the date of receipt of a certified copy of this order.
This application is, accordingly, disposed of with the above orders.
