Heard Sri Babu Lal holding brief of Sri Arjun Singh Yadav, learned counsel for petitioner and learned A.G.A. for State of U.P.
This writ petition has been filed for quashing the F.I.R. dated 31.01.2019 registered as Case Crime No. 25 of 2019 under Sections 498A, 304B I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station -Thriyon, District-Fatehpur.
In the F.I.R. in substance the allegation has been made that Rajani daughter of the informant was married to Suraj Singh on 20.04.2018. At the time of marriage the dowry was given by the informant according to the capacity but thereafter, the accused began to demand one motorcycle and Rs. 30,000/- cash due to non fulfilment of demand, they used to torture and assault the deceased on 30.01.2019 the accused committed murder of Rajani by hanging her.
In the F.I.R. it discloses the cognizable offence as such it is not liable to be quashed.
However, it is directed that in case the petitioner appear and surrender before the court below and apply for bail, her prayer for bail shall be considered and decided expeditiously according to law and suitable order be passed on it.
With the above directions, this writ petition is disposed of finally.
