By means of this contempt application invoking the jurisdiction under Section 12 of the Contempt of Courts Act, the applicant alleges non-compliance of the order of Division Bench of this Court dated 9th November, 2017 partly allowing the First Appeal From Order No. 220 of 2001.
The contention of the learned counsel for the applicant is that after the order was passed by this Court, the applicant made an application to the Oriental Insurance Company for necessary compliance.
In the opinion of the Court, the applicant should have approached the Motor Accident Claims Tribunal for the execution of the award.
It is, therefore, directed that in case if the applicant approaches the Tribunal for the execution of the award in compliance of the order of this Court passed in First Appeal From Order (supra), the Tribunal shall proceed to execute the award within a reasonable period of time, since the award has been made under the beneficial legislation.
With the aforesaid observation, the contempt application stands disposed of.
