Petitioner/Accused No.2 AND The State of A.P., Through Police, Ramgopalpet, Rep., by the Public Prosecutor, High Court, Hyderabad . Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioner on bail in the event of her arrest in Cr.No.14/2014 of P.S. Ramgopalpet, Secunderabad.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri M. Achutha Reddy, Advocate for the Petitioner and Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner is A2. She seeks for grant of anticipatory bail. She allegedly committed an offence under Section 420 IPC. The husband of the petitioner, who is A1, allegedly cheated the de facto complainant to a tune of Rs.40.00 lakhs. The de facto complainant as well as the husband of the petitioner are doctors. The learned counsel for the petitioner submitted that the petitioner has nothing to do with the transaction between her husband and the de facto complainant and that the case was falsely foisted against her.
The petitioner is a lady. In view of the defence of the petitioner and in view of the amount involved in the case and also in view of the sex of the petitioner, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Hence, this Petition is allowed. The petitioner shall surrender before the XI Additional Chief Metropolitan Magistrate, Secunderabad, within two weeks from today. On such surrender, the learned XI Additional Chief Metropolitan Magistrate, Secunderabad, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
