Heard learned counsel for the petitioner, Standing Counsel for the State and Ms. Pooja Agrawal, learned counsel appearing on behalf of respondents no. 2, 3, 4 and 5.
The present petition has been filed alleging that the petitioner joined service in the office of the District Judge Moradabad on 16.1.2010 in terms of the appointment letter dated 11.1.2010. After creation of new District Sambhal, the petitioner opted District Sambhal, however, despite option, the petitioner was transferred to District Moradabad on the ground that non-judicial enquiry is pending against the petitioner.
The petitioner claims that the said enquiry has resulted in exonerating the petitioner. He further claims that on 28.7.2016 an order was passed by the District Judge, Moradabad promoting employees working in the Grade Pay of Rs. 2000/-. The petitioner claims that his name in the list appeared at serial no. 2, however, the petitioner was not granted the promotion only on account of alleged pendency of non-judicial enquiry. He also claims that despite the completion of the enquiry the claim of the petitioner has not been considered and the same is pending before the District Judge, Sambhal as the petitioner was transferred to District Court Sambhal in the year 2019.
Ms. Pooja Agrawal, learned counsel, appearing on behalf of respondents no. 2 to 5 states that the representation of the petitioner is pending consideration before the District and Sessions Judge, Sambhal, the same shall be decided with all expedition, preferably within a period of four months from today.
The writ petition stands disposed off in terms of the said undertaking given by Ms. Pooja Agrawal.
