JUDGMENT / ORDER

The petitioner has liability with the respondent on account of the subscription of two chitties. The petitioner submits that he is under treatment and is unable to raise necessary funds to discharge liabilities. Therefore, the petitioner seeks an instalment facility to pay off the liability. The petitioner submits that he needs 60 instalments to pay the liability.
2. The learned Standing Counsel for the respondent opposed the prayer and submits that only 12 instalments can be given to the petitioner.
Considering the facts and circumstances, the petitioner is permitted to pay off the liability in 18 instalments starting from January, 2015. However, if the petitioner commits two W.P.(C) No.32544 of 2014 2 consecutive defaults in paying the instalments, the benefit granted to the petitioner will stand forfeited and the respondent is free to proceed against the petitioner in accordance with law.
The writ petition is disposed of as above.
