Heard Sri Ashok Khare, learned senior counsel assisted by Sri Shantanu Khare, learned counsel for the petitioner, Sri A.K. Yadav, learned counsel representing the respondent no.3 and learned standing counsel represents nos. 1 and 2.
By means of present writ petition the petitioner has prayed for transfer from Faizabad to Bareilly.
The fact of the case are that the petitioner is performing her duties as Assistant Teacher in Junior Basic School at Faizabad. The petitioner has submitted an application for transferring her from Faizabad to Bareilly which was accorded by the competent authority and thereafter a three member committee was constituted to consider the claim of the petitioner.
The said three member committee has considered the claim of the petitioner and has accepted vide order dated 20.4.2018, a copy of the report of the three member committee is enclosed as Annexure 21 of the writ petition.
Learned senior counsel has submitted that though the committee constituted by the respondents has accorded the approval of transferring the petitioner from Faizabad to Bareilly no orders are passed by the respondent.
Learned counsel for the petitioner has placed reliance of the contents of paragraph 21 of the writ petition which is quoted hereinbelow :
"That on 28.3.2018 the petitioner filed her representation. A true copy of representation of petitioner is being filed herewith and marked as Annexure 13 to this writ petition."
Having heard learned counsel for the parties the writ petition is disposed of by directing the respondent no.3/competent authority to consider the claim of the petitioner as also the report dated 20.4.2018 submitted by three members committee and pass appropriate reasoned and speaking order strictly in accordance with law preferably within a period of thirty days from the date of production of certified copy of this order.
