Heard Sri Mohd. Ayub for the petitioner and A.G.A. for the State of U.P.
The writ petition has been filed for issuing a mandamus directing Superintendent of Police, Agra and Station House Officer, P.S. Rakabganj, Agra(respondents-2 and 3 respectively) to ensure fair investigation in Case Crime No.077 of 2018 under Sections 302, 201, IPC P.S. Rakabganj, district Agra.
It is stated that F.I.R. was lodged on 12th March, 2019 but the police is not proceeding in the matter.
In the fact of the case the writ petition is disposed of with the direction that Superintendent of Police, Agra and Station House Officer, P.S. Rakabganj, Agra(respondents-2 and 3 respectively) to ensure fair and impartial investigation in Case Crime No.077 of 2018 under Sections 302, 201, IPC P.S. Rakabganj, district Agra and submission of police report under Section 173(2) Cr.P.C. in it as early as possible, preferably within a period of four months from the date of production of a certified copy of this order before them.
