JUDGMENT / ORDER

1. The present petition under Article 226 of the Constitution of India has been preferred by the petitioner herein – original accused for an appropriate writ, order and/or direction, directing the respondents to give benefit of set-off of 2 years 6 months and 94 days and release him finally from jail upon payment of fine as no other case is pending against him.
2. Mr.L.B.Dabhi, learned Additional Public Prosecutor appearing on behalf of the respondents, under the instruction from Jail Authority at Surat, as stated at the bar that the petitioner has been released from Jail on and from 03/02/2007 and the petitioner has also paid the fine of Rs.1,11,000/- on 03/02/2007. Under the circumstances, the present petition has become academic and it has become infructuous.
3. In view of the above, the present petition is dismissed as having become infructuous. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith.
