Heard learned counsel for the applicant and the learned AGA.
This application under Section 482 Cr.P.C. has been filed for quashing the charge sheet submitted in Special Case No. 304/2002 in Cr. No. 411 of 2001 under Section 2/3 U.P. Gangster Act, P.S.-Khatauli, Muzaffar Nagar pending in the Court of Special Judge, Gangster Act, Meerut.
The fact that the applicants stand arraigned in more than five criminal cases including under the Goondas Act is not disputed. The submissions which were advanced at the stage of admission namely of there being no independent witness cannot possibly be a ground for invocation of the inherent jurisdiction of the Court.
The application is dismissed. The interim protection shall stand discharged.
