JUDGMENT / ORDER

----------------------- The petitioner is the holder of Passport bearing No.9333597. The petitioner has obtained the Passport on 26.5.1987 and renewed it on 7.9.2006. Ext.P3 is the copy of the Passport. On expiry, the petitioner renewed the Passport from Indian Embassy, Muscat in Sultnate of Oman. The petitioner now seeks to correct the Passport as there is a difference in the date of birth. The petitoner’s date of birth is shown in the passport as 12.12.1962. According to the petitioner, actual date of birth is 20.5.1972. The petitioner approached the 2nd respondent to correct the entry regarding the date of birth by Ext.P7 application. The petitioner has been directed to produce a court order.
2. A statement has been filed by on behalf of the second respondent. It is stated that the difference of date of birth is more than 10 years. Therefore the petitioner has to surrender his Passport.

that even if the disparity is of more than two years, the Passport authorities have power to correct the passport.
4. In view of the above, without the aid of the court order, passport authority shall correct the details of the passport on being satisfied with the genuineness of the claim of the petitioner. The petitioner shall file an affidavit along with the jugment detailing reasons for discrepencies in the Passport. Neeful shall be done within a period of four weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
