Supplementary filed by the learned counsel for the applicant, is taken on record.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in Case Crime No.23 of 2019, under Sections 489-D IPC, P.S. Saraimeer, District Azamgarh with the prayer to enlarge him on bail.
Contention of learned counsel for the applicant is that the applicant has been falsely implicated in the present case; that there is no independent witness of the alleged recovery; that alleged recovery is false and bogus; that there is no evidence that that applicant-accused has used the alleged counterfeit currency; that as per the prosecution version alleged recovery was shown from the applicant and co-accused; that applicant- accused is on bail in all the cases, which have been shown in the criminal history of the applicant; and that in case the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial and that he is languishing in jail since 13.02.2019.
Learned A.G.A. has opposed the prayer for bail and argued that counterfeit currency of Rs.3,50,000/- has been recovered from the applicant and co-accused; and that applicant has criminal history of seven cases including that of murder case.
As per prosecution version, counterfeit Indian currency of Rs.3,50,000/- has been shown from the applicant and co- accused. Keeping in view submissions of learned counsel for the parties, quantity of recovered currency, nature of the offence, criminal history of applicant and considering all attending facts and circumstances of the case, no case for grant of bail is made out.
Accordingly, the application for bail is rejected.
