JUDGMENT / ORDER

1. Learned advocate Mr. Premal S. Rachh for the petitioners does not press this petition. However, he requests that the Trial Court may be directed not to be influenced by any of the observations made in any of the orders while deciding Exh.5 application.
2. It is needless to say that the decision taken for deciding Exh. 5 application is always at interim stage and such decision, being tentative in nature, can never come in the way while deciding the suit.
3. With the above observations, the petition is disposed of. Notice is discharged. Interim relief, if any, stands vacated forthwith.
