The submission of learned counsel for the petitioner is that the petitioner was posted as Go-down Incharge at Behta, district Sitapur on 06.03.2007 and enquiry report submitted by the Police Inspector, Food Cell indicates the period of irregularities from March, 2006 to December, 2006. As the petitioner was not posted at the relevant time at the Go-down in question, therefore, there is no occasion of his involvement in the commission of irregularities and, therefore, no question of lodging First Information Report against him and if any FIR is lodged, this will be unnecessary harassment of the petitioner.
Sri Anil Saran, learned counsel appearing for the opposite parties no. 3 and 4 prays for and is granted three days' time to seek instruction in the matter with respect to involvement of the petitioner in the concerned irregularities.
