JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE FOURTH DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.37209 of 2014 BETWEEN Nawabuddin Khazi and another AND ... PETITIONER The State of Telangana, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Mr. Ramakanth Reddy, learned counsel appearing for the petitioner, fairly submits that though the proceedings under Section 145 Cr.P.C. issued by the Revenue Divisional Officer (RDO) is questioned in the writ petition, in view of the fact that respondent No.2 is required to give notice to both the parties and hear them and pass a final order in terms of Section 145 Cr.P.C. Learned counsel for the petitioner, therefore, requests that the RDO be directed to follow the same course.
3. Instructions received by the learned Government Pleader show that the decision to invoke proceedings under section 145 Cr.P.C. was taken to maintain peace and law and order.
4. However, the impugned order dated 26.11.2014 shows that the notice was ordered to all the parties and if all the parties were served, the RDO shall give them opportunity to file their respective claim statements, hear them, and pass appropriate final order in terms of Section 145 C.r.P.C. as expeditiously as possible.
In view of the same, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
