Heard Sri Vijit Saxena, learned counsel for the petitioner, Sri D.S. Chauhan, learned counsel appearing for the respondent no. 3, learned Standing Counsel for the respondent nos. 2 and 3 and perused the record.
From the pleadings that have come to be raised in the present writ petition, it transpires that there is a serious dispute of title in respect to the land in question. The petitioner has claimed title on the basis of a sale deed executed prior to the date of vesting. At this juncture, learned counsel for the petitioner submits that he may be permitted to withdraw this petition to pursue the remedy of civil suit.
In view of above, the petition is dismissed and consigned to record.
