Criminal Misc. Recall Application No. 4 of 2019 supported by affidavit is taken up.
This application has been filed with a prayer to recall the order dated 27.11.2019 passed by this Court whereby non bailable warrants were directed to be issued against the appellant No. 1- Nawab Singh, appellant No.-2, Vankhandi and appellant No. 3 Ram Lachhin due to non appearance of their counsel.
Today, Mr. Sanjay Singh, Advocate has filed Vakalatnama on behalf of the appellant Nos. 2 and 3. The same is taken on record. The appellant No.-2 and appellant No.-3 are also present before this Court and have been identified by their counsel Sri Sanjay Singh.
Since the appellants No. 2 and 3 are represented by their counsel, we recall the order dated 27.11.2019 to the extent of issuing non-bailable warrants against the appellant Nos. 2 & 3.
Recall application is allowed in respect of appellant Nos. 2 & 3.
So far as the appellant No.-1 Nawab Singh is concerned, learned counsel submits that he has expired in the year 2017.
The office is therefore directed to send a letter to the C.J.M., Agra to submit living status report of the appellant No.-1 Nawab Singh in terms of the High Court Circular Letters No. 15/2005, VIII-119 April 19, 2005 and 04/admin G-II dated Allahabad 18.01.2017 by the next date.
List on 9.1.2020 alongwith the report of C.J.M. as well as office report.
