Heard learned counsel for the revisionists and Sri Abhinav Prasad, learned A.G.A. for the State.
Present revision has been filed for setting aside the order dated 20.04.2019 passed by Additional Chief Judicial Magistrate, Sadabad, Hathras in Case No. 1293 of 2017 (State Vs. Nawab Khan and others) arising out of Case Crime No.
501 of 2017, under sections 498A, 323, 325, 504, 506 IPC & 3/4 Dowry Prohibition Act, Police Station Kotwali, District Hathras, whereby discharge application filed by the revisionists has been rejected.
Learned counsel for the revisionists contends that the discharge application filed by the revisionists has been illegally rejected. Learned counsel further contends that the revisionists are on bail.
After hearing the learned counsel for the revisionist, learned A.G.A. and after perusing the order impugned as well averments made in the present revision, this Court is of the opinion, that learned counsel for the revisionist could not point out any legal infirmity in the order impugned which may warrant any interference by this Court in exercise of revisional jurisdiction.
Accordingly, the prayer for setting aside the order impugned is refused.
However, the present revision is disposed of with the direction to Additional Chief Judicial Magistrate, Sadabad, Hathras to consider and conclude the Case No. 1293 of 2017 (State Vs. Nawab Khan and others) arising out of Case Crime No. 501 of 2017, under sections 498A, 323, 325, 504, 506 IPC & 3/4 Dowry Prohibition Act, Police Station Kotwali, District Hathras, as expeditiously as possible in accordance with law, preferably within a period of six months from the date of production of a certified copy of this order, after hearing the concerned parties without granting unnecessary adjournment to either of the parties, in case the proceedings of the aforesaid case is not stayed by any Court.
