Petitioner has approached this Court seeking mandamus to command the respondents no.1 and 2 to take action against the respondents no.3 and 4, who are private persons and are disturbing the peaceful possession over the land of the petitioner and making construction thereon forcefully.
It is more than obvious that there is a dispute in respect of the property between the petitioner and private respondents no.3 and 4. It is well settled that mandamus cannot be issued to the administrative authorities to decide private disputes in respect of the property. The petitioner has remedy under the common civil law and he may avail the same, if so advised. The relief sought for in this writ petition is not liable to be granted.
Accordingly, the writ petition stands dismissed.
