Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The only prayer made by the applicant is that a direction be issued to the learned Civil Judge (Junior Division)/Judicial Magistrate, Gunnaur, Sambhal at Chandausi to expedite the proceedings of Case No. 17 of 2019 (State Vs. Nawab Ali and others) arising out of Case Crime No. 232 of 2018, under section 382, 411 I.P.C., P.S. Dhanari, District Sambhal at Chandausi within the stipulated period.
Learned counsel for the applicant contended that accused- applicant is in jail since 12.12.2018 even charge has not been framed yet.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this application under section 482 Cr.P.C. is finally disposed of with a direction to the learned Civil Judge (Junior Division)/Judicial Magistrate, Gunnaur, Sambhal at Chandausi to expedite the proceedings of Case No. 17 of 2019 (State Vs. Nawab Ali and others) arising out of Case Crime No. 232 of 2018, under section 382, 411 I.P.C., P.S. Dhanari, District Sambhal at Chandausi in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order, if there is no legal impediment.
