ORDER:
This writ petition is filed on apprehension that respondent No.3 may re-assign the land admeasuring Acs.3.54 cents in Survey No.187/4 of Padavenkannapalem Village, Ponnalur Mandal, Prakasam District, though the same was assigned to the petitioner under a D-Form Patta No.105/05, dated 25.01.2005.
At the hearing, the learned Assistant Government Pleader for Revenue (Assignments), on instructions, submitted that as the record pertaining to the purported assignment in favour of the petitioner was not available, there were proposals for assignment of the subject land to the eligible third parties and that after filing of the present writ petition in which the petitioner filed a copy of D- Form Patta, respondent No.3 is proposing to initiate an enquiry into the claim of the petitioner that the D-Form Patta was already issued to him. He further stated that during the enquiry, if it is found that D-Form Patta was issued to the petitioner, the subject land will not be re-assigned to anyone else and that in a converse situation, an appropriate order will be passed and communicated to the petitioner before assigning the land to third parties.
In view of the above submissions of the learned Assistant Government Pleader, the writ petition is disposed of.
As a sequel, W.P.M.P.No.41603 of 2013 is disposed of as infructuous.
