The grievance of the petitioner is that the appeal filed against the order dated 8.1.2019 was not being decided and, therefore, a prayer has been made that the appeal be decided within a stipulated period of time.
Learned counsel for the petitioner submits that as per Clause 13(3), an appeal which has been filed under Clause 13(1) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016, was required to be decided within a period of 60 days from its filing.
Since the appeal itself had been filed in the month of January, 2019, and proceedings were initiated thereafter, it is being directed that the Appeal itself be decided within a period of one month from the date of production of a certified copy of this order. If any stay application is pending, orders on it shall be within a period of one week from the next date fixed.
The writ petition is disposed of.
If any appointment takes place, it shall be subject to the decision of the Appeal.
