Naik, learned Senior Counsel appearing with Mr.Parthiv Bhatt, learned counsel for the petitioner tenders undertaking on affidavit to the following effect:-
"I state that the petitioner-Trust has stopped construction since the notice issued by the respondents dated 2.6.2012 was received by the Trust on 6.6.2012 and the said fact has been communicated to the respondents by reply dated 6.6.2012. I further state that, after receipt of the notice dated 2.6.2012, the petitioner-Trust has not carried out any construction from 6.6.2012 till date. I state and undertake that the petitioner-Trust will not carry out any further construction till necessary permission for putting up construction by way of cement concrete roof over the Hall is received by the petitioner-Trust for higher secondary section of the school. Photographs of the Hall with part-construction which has been stopped from 6.6.2012 are produced herewith."
3. Respondent No.2 herein, upon being served with the copy of this order, shall carry out the panchnama of the construction already made by the petitioner-Trust and produce the same on record on the returnable date.
4. In the meanwhile, no coercive steps shall be taken by the respondents. Direct service today is permitted.
