Heard learned counsel for the applicant and the learned AGA.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the learned Addl. Chief Judicial Magistrate, Court No. 4, Agra to decide Criminal Case No. 241 of 2013, State Vs. Mahesh Chand Pathak (Old Case No. 2138 of 2006) arising out of Case Crime No. 107 of 2006, under Sections 420, 406, 467, 468, 471 IPC, P.S. Hari Parwat, District- Agra expeditiously within stipulated period.
Learned counsel for the applicant has submitted that applicant is the first informant in the present case, the proceedings of which, are pending since 2006 and has not yet been disposed of and has been lingering-on, on one pretext or the other.
In view of the above, the Addl. Chief Judicial Magistrate, Court No. 4, Agra is expected to make all endeavours to decide the aforesaid case expeditiously, preferably within a period of one year from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the application u/s 482 Cr.P.C. is finally disposed of.
