JUDGMENT / ORDER

1.Learned advocate Shri Asthavadi was on his leg since 1:15, as per his own submission, and he continued till 3:25 i.e. after recess. When the Court inquired of him in respect of various lacunas meriting rejection of the matter, Shri Asthavadi requested for time so as to bring on record unreported decisions of this Court in which, as per his submission, this Court has frowned upon the authorities for discrimination that in some cases seeking grant the lacunas have been overlooked, whereas in cases like petitioner, the lacunas have not been overlooked. In short he seeks time to place on record decisions or unreported decisions of this Court, wherein SCA/14261/2011 2/2 ORDER this Court, in his submission, have observed that lacunas if not taken into consideration in case of other colleges the same cannot be held out against the present petitioner, and despite lacuna the petitioner's application for grantable status should have been granted.
2.It is unfortunate that the learned advocate while arguing the matter was not ready with the judgments or authorities to be cited in the case. The Court need not delve upon the conduct, but suffice it to say that the consumption of forensic time from 1:15 to 1:45 and again from 2:30 to 3:25 is unfortunate and deplorable. At the request of learned advocate Shri Asthavadi, matter is adjourned to 28.02.2012. No further time shall be granted in this matter.
