Learned advocate appearing for the petitioner urged that in Regular Civil suit No. 41 of 2011, an application below Exh.6 under Order 26 Rule 9 of CPC is preferred for appointment of Court Commissioner to create evidence in favour of the plaintiff who has chosen not to proceed with the hearing of the injunction application.
