JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Learned AGP files reply of the respondent with the copy to the counsel for the applicant.
Grievance of the applicant is that despite direction of this Court in order dated 23.09.2011 passed in Special Civil Application No. 14353 of 2011 to consider and decide the case of the applicant being case No. 405 of 1999 within a period of four weeks from the date of receipt of copy of this order, no decision has been taken by the opponent so far.
On the basis of the affidavit, learned AGP submitted that the issues are complex and the applicant has been asked to supply certain details. However, details would have to be called from other branches. Some more time may therefore be granted.
We are of the opinion that, if the respondent was not in a position to meet with the deadline provided by this Court, the better option would have to apply for extension thereof. However, in facts of the present case, we would not like to take a very serious view of the matter particularly, when it is pointed out that various aspects have to be examined before final decision can be taken.
Under the circumstances, this contempt petition is disposed of directing that the respondent herein shall take a decision, as provided by the learned Single Judge in order dated 23.09.2011, latest by 31.07.2012.
It is clarified that the stand of the applicant, that number of details called for by the respondent are not relevant, is not examined by us in the present case.
With above observations and directions, the contempt petition is disposed of. Notice is discharged.
