Challenging the orders of both the Courts, being the trial Court and the Appellate Court concurrently denying relief of injunction to the present petitioner in Regular Civil Suit No. 86 of 2009 preferred before Principal Civil Judge (SD), Ankleshwar as also in Civil Misc. Appeal No. 6/2010 filed on 25.1.2010 respectively, this petition is preferred under Article 227 of Constitution of India.
Learned advocate Mr.Shastri pointed out to this Court communication dated 30th March, 2009 where demand draft No. 663493 dated 20th December, 2008 of Bank of Baroda, Industrial Estate Branch, Ankleshwar of Rs.8,13,823/- has been returned and allotment of the very plot having been made to M/s.Krishna Chemicals as an allottee of Plot No. 6726 GIDC, Ankleshwar dated 3.2.2009. He has urged that no procedure much less legal procedure has been followed by respondent No. 1 herein.
SCA/5929/2012 2/2 ORDER Issue notice to respondent No.1 and 6 making it returnable on 2nd May, 2012. Respondent No.1 shall also cause to bring the original file of allotment on the returnable date. Direct service is permitted.
