Heard Sri Surendra Prasad Mishra, learned counsel for the petitioners and Sri Brajesh Shukla, learned counsel for the respondent no.2.
Present writ petition has been filed challenging the order dated 24.5.2017 passed by Deputy Director of Consolidation, J.P. Nagar, whereby the earlier order passed by the Deputy Director of Consolidation was recalled by allowing restoration applications dated 3.6.2015 and 8.9.2016 filed by Gaon Sabha as well as respondent nos. 6 and 7.
Specific finding has been recorded that no opportunity has been given either to Gaon Sabha or respondent nos. 6 and 7 while passing the earlier order passed by Deputy Director of Consolidation and by the impugned order only recall application has been allowed restoring the revision to its original number.
I do not find any illegality or infirmity in the order impugned herein as the petitioners having opportunity to contest the revision on merits.
Writ petition lacks merit and is, accordingly, dismissed.
