JUDGMENT / ORDER

Rule.
Learned APP waives service of Rule on behalf of the respondent-State.
The applicant, a life-convict has preferred this application for temporary bail on the ground of death of his real brother as per the death certificate dated 16.05.2012 annexed with this application, which reveals that Nagvadiya Nanjibhai died on 15.05.2012 at Village:Visavadi, Ta:Dasada, Dist:Surendranagar. No doubt, in the past, in the year-2000, when the applicant was released, he had surrendered late to the jail authority by 3136 days for which two furlough came to be forfeited but, otherwise jail conduct appears to be reasonably good.
Considering the over all aspect of the matter, in absence of father of the applicant, who is no more in this world and widow mother of the applicant is aged about 70 years, I am inclined to consider this case and hereby grant Two weeks of temporary bail from the date of his release on furnishing personal bond of Rs.5,000/- (Rupees Five Thousand) to the satisfaction of the jail authority on usual terms and conditions. While on temporary bail, the applicant shall report to the nearest Police Station once in a week. On completion of the temporary bail, the applicant shall surrender before the jail authority in time.
Rule is made absolute. Direct service is permitted.
