Heard learned counsel for the applicant and the learned A.G.A.
This bail application has been filed on behalf of the applicant involved under Sections 304, 323, 336, 504, 506 IPC, P.S. Hathras Gate, District Hathras arising out of case crime No. 409 of 2011.
Learned counsel for the applicant submits that the allegation is false; applicant is not involved in the commission of the offence; applicant is innocent and has been falsely implicated; he is in jail since 10.2.2018.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that applicant is the husband of the deceased and was having dispute with her for money; in the dying declaration she has stated that the applicant had burnt her after pouring kerosine oil.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application of the applicant Naveen Sharma.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
