The petitioners allege that the U.P. State Highways Authority is intending to take possession of the land belonging to the petitioners without resorting to acquisition proceedings and without payment of compensation.
This factual aspect can be determined by the District Magistrate, Saharanpur if a representation is filed by the petitioners before him.
Learned Standing Counsel appearing for the respondents states that in case a representation is filed by the petitioners, it shall be decided at an early date.
This petition is, accordingly, disposed of with a direction that in the event the petitioners file a representation along with a certified copy of this order before the District Magistrate, Saharanpur, a decision shall be taken expeditiously and preferably within a period of two months from the date of filing of the representation.
It is made clear that the Court has not adjudicated on the merits of the matter and it will be for the District Magistrate, Saharanpur to take a decision in accordance with law.
