Naveen Kumar & Others vs State Of U.P., Thru. Prin. ...

High Court Of Judicature at Allahabad|28 June, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and the learned Additional Government Advocate.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.297 of 2010 under Sections 323, 504, 506 I.P.C and Section 3 (2) (x) of SC & ST Act, Police Station Bheeti, District Ambedkar Nagar.
We have gone through the consents of the FIR which disclose commission of cognizable offence, as such the same cannot be quashed.
However, seeing the allegations levelled in the FIR, which seem to be trivial in nature, we direct that the petitioners shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against them, provided they cooperate with the investigation, which shall go on.
With the aforesaid observations/directions, the writ petition is disposed of.
