THIS APPEAL COMING ON FOR CONCILIATION BEFORE LOK ADALAT, AFTER BEING REFERRED BY THE COURT, THE FOLLOWING CONCILIATION ORDER IS PASSED.
CONCILIATION ORDER Both the parties and respective counsels present. They have filed an application U/o XXIII Rule 3 of CPC.
2. The parties have admitted the execution of the compromise petition before this Lok Adalat and they have no further litigation in this regard.
3. According to the terms as narrated in the application, the order passed by the SSCH-11, Bengaluru in MVC No.4844/2017 is hereby setaside. Consequently, the appeal in MFA.No.8209/2018 is disposed of in terms of the compromise.
4. Today in terms of the compromise, the appellant making payment of Rs.5,50,000/- by way of Demand Draft in No.609269, dated 14.12.2018 drawn on State Bank of India, Rajanukunte, Branch, Bengaluru. The said D.D. duly accepted by the respondent herein. The entire Court fee is ordered to be refunded to the appellant.
5. This Miscellaneous First Appeal stands disposed of in terms of the Compromise Petition. The Judgment and Award of the Tribunal shall stand modified accordingly. Draw up the Award accordingly.
