Issue fresh notice to respondent no.4, who may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks. List this matter after expiry of the aforesaid period. In the meanwhile the investigation may go on, but the petitioner Naveen Jain alias Parveen Jain, who is involved in case crime no.698 of 2009,under Section 3/7 of Essential Commodities Act, P.S.Sirsaganj, District Firozabad, will not be arrested till the next date of listing or till submission of the police report under Section 173(2) Cr.P.C. (whichever is earlier) provided he cooperates in the investigation.
