It is submitted by learned counsel for the petitioner that name of the petitioner surfaced in the confessional statement of co- accused Anil Kumar Yadav, F.I.R. is malafidely motivated and the same is liable to be quashed.
Shri A.N. Mulla, the learned A.G.A. rightly submits that such issue cannot be examined in writ jurisdiction as investigation is in progress.
The writ petition is devoid of merit and is accordingly, dismissed.
