JUDGMENT / ORDER

The petitioner is the holder of passport No.M0529539. The petitioner wants to correct the date of birth. The petitioner approached the Passport Issuing Authority to correct the details of date of birth in the passport. By Ext.P5 the petitioner has been directed to produce court order. It is submitted that the petitioner obtained passport in the year 1993 and disparity is more than three years.
2. In view of the decision of this Court in Nizar V. Union of India - 2014 (4) KLT 609 held that even if the disparity is more than two years, the Passport Issuing Authority has power to correct the date of birth, on being satisfied with the genuineness of the certificates. Therefore, passport authorities can correct the date of birth in the passport, subject to satisfaction of the claim.

3. In the above facts and circumstances, the petitioner shall appear before the Passport Issuing Authority along with this Court Order and explain reasons for differences in the passport regarding the date of birth by filing an affidavit and on being satisfied with the genuineness of the claim, necessary action shall be taken by the passport authorities in accordance with law within a period of four weeks.
The Writ Petition is disposed of accordingly.
