JUDGMENT / ORDER

Petitioner has approached this Court complaining about the action taken by the Tahsildar in terms with Ext.P14 inter alia contending that against the order passed by the Tahsildar in terms with Ext.P11, he had already preferred an appeal as Ext.P13 before the Sub Collector.
2. The facts involved in the case would disclose that the petitioner claims to be a member of the Scheduled Caste. He obtained a job in State Bank of Travancore as a Clerk. His certificates were verified and by Ext.P11, the 5th respondent formed an opinion that the petitioner is not entitled for a certificate as Hindu Valluva whereas he is only a Hindu-Thiyya. In Ext.P11 order, he was also informed that he has a right of appeal under Section 12(1) of the Kerala (Scheduled Caste and Scheduled Tribe) Regulation of issuance of Community Certificate Act, 1996. It is pursuant to the same that the petitioner preferred Ext.P13 appeal. In W.P.C.No.13906/2014 2 the meantime, according to the petitioner, the 4th respondent had forwarded a letter Ext.P14 to the Scrutiny Committee for verification of the community certificate and to take appropriate proceedings in accordance with the procedure prescribed under the said Act.
3. Petitioner requests for disposal of Ext.P13 appeal and the stay of Exts.P11 and P14 till a final decision is taken on Ext.P13.
4. Having regard to the aforesaid factual situations and after hearing the petitioner, I am of the view that the writ petition can be disposed of as under:
4th respondent shall consider Ext.P13 and pass appropriate orders within a period of one month from the date of receipt of a copy of this judgment and until such time no further proceedings shall be taken pursuant to Ext.P11 and P14.
