JUDGMENT / ORDER

Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that he contended that the applicant went to the shop of the informant and for recharge coupon some altercation took place, hence the applicant was falsely implicated in the case of theft. The theft was shown in the night of 15/16.2.2010 and the First Information Report was lodged on 7.3.2010. Subsequently the recovery of two mobiles were shown from the applicant and he was also challanned under N.D.P.S. Act in which he has already been released on bail. There is no criminal history against the applicant However, in the present case, he is in jail since 7.3.2010.
In view of the above, without expressing opinion on merit, let the applicant Naval Kishore alias Gajju be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No.43 of 2010 under Section 457, 380, 411 I.P.C. PS Loha Mandi District Agra.
