Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 to 3 and Sri Shyam Mani Shukla, learned counsel for respondent nos. 4 and 5.
Learned counsel for the petitioner submitted that he was an employee of Nagar Palika Parishad Khurja, Bulandshahar and ultimately retired from service on 31.10.2013. He further submitted that after retirement, pension was revised and he has not been paid the revised pension from 16.12.2016 to 31.12.2017, which is amounting to Rs. 1,25,949/-. He further submitted that for redressal of his grievance, he has moved a representation dated 7.7.2018 before respondent no. 4 (Executive Officer, Nagar Palia Parisha Khurja, Bulandshahar), but till date, the same has not been decided. Lastly, he prayed that a suitable direction may be issued to respondent no. 4 to decide the representation of the petitioner within a time bound manner.
Learned counsel for the respondents has no objection to the prayer made by the petitioner.
Considering the facts and circumstances of the case, with the consent of parties, without adverting the merits of the case, the writ petition is disposed of with direction to respondent no.4 (Executive Officer, Nagar Palia Parisha Khurja, Bulandshahar) to decide the representation of the petitioner dated 7.7.2018 strictly in accordance with law within a period of two months from the date of production of certified copy of this order. However, it is open for the petitioner to file a fresh representation along with certified copy of this order.
