JUDGMENT / ORDER

The petitioner intends to start a business for which he had already obtained license from the Local Self Government Institutions as per Ext.P1. The business has not yet been established and for the purpose of establishing the same, the petitioner had purchased a “Fryer” from outside the State and during the course of transportation, the same was detained at the Check post at Valayar. The reason for detention as revealed from Ext.P2 is that the petitioner is not a registered dealer and there was no supporting documents to prove that the consignment is for his own use. In such circumstance, an amount of Rs.58,000/- was demanded from the petitioner for transporting of the goods. It may not be proper for this Court to go into the merits of the contentions, WPC No.12847/2014 ::2:: however, noticing that the petitioner has obtained a license for starting a Fried Chicken Unit and the goods purchased is a “fryer” which is to be used in the said establishment, it is deemed fit that there be a direction to the respondents to release the goods on payment of Rs.24,000/- and execution of simple bond without sureties for the balance amount. The proceedings shall be completed within a period of four months from today.
Writ petition disposed of as above.
