Heard Sri N.K. Singh, learned counsel for the petitioner, Sri A.R. Chaurasia, learned AGA for the State and perused the record.
This petition has been filed with the prayer to direct the respondent no.2 to transfer the investigation of FIR dated 5.8.2018, registered as case crime no.485 of 2018, u/s 147, 148, 149, 302, 120-B IPC, P.S. Mau Darwaza, district Farrukhabad to any other district or other vigilance agency for fair and impartial investigation.
Learned counsel for the petitioner submits that the petitioner is the informant of the present case. He has come up before this Court with the prayer to direct the respondent no.2 to transfer the investigation to any other district or other vigilance agency for fair and impartial investigation.
Learned AGA opposed the aforesaid prayer and submitted that the present FIR has been lodged on 5.08.2018. The mandatory period of 90 days has not expired, hence present petition is liable to be dismissed.
After having considered the submissions advanced by learned counsel for the parties and from the perusal of the FIR, we do not find any good ground to interfere in the matter.
The writ petition is, accordingly, dismissed at this stage with liberty to file fresh petition at an appropriate stage.
