JUDGMENT / ORDER

Hon'ble Dinesh Kumar Singh,J.
1. Notice for opposite party No.1 has been accepted by learned C.S.C. whereas notice on behalf of opposite party Nos.2 to 4 has been accepted by Mr. Gaurav Mehrotra, Advocate.
2. This writ petition has been filed seeking following reliefs:-
"(i) Issue a writ, order or direction in the nature of certiorari thereby quash the impugned election result dated 22.07.2021 as well as election proceeding of society i.e. Matsya Jeevi Sakkari Samiti Limited Majhra Poorab Block-Ramiabehad, Tehsil- Nighasan, District Kheri after summoning the same from the opposite parties.
(i) issue a writ, order or directionin the nature of mandamus thereby commanding and directing the opposite parties to conduct the fresh election of Board and Directors in Majhra Poorab Block-Ramiabehad, Tehsil- Nighasan, District Kheri by giving opportunity of particiapting in election to all the persons who are having desires, in the interest of justice.
(ii) Issue any other order, or direction deemed just and Equitable under the circumstances of the case in favour of the petitioners.
(iii) Allow the writ petition."

Preliminary objection has been raised by Mr. Gaurav Mehrotra, learned counsel appearing for opposite party Nos.2 to 4 on the ground that the petitioner has statutory alternate remedy for filing a election petition under Rule 50 of U.P. State Cooperative Societies Election Rules 2014 read with Section 70 of U.P. Co-operative Societies Act, 1965 which may be availed by him.
4. Learned counsel for the petitioner submits that he is ready to file election petition under Rule 50 of U.P. State Cooperative Societies Election Rules 2014 read with Section 70 of U.P. Co-operative Societies Act, 1965. However, the same may be decided in a time bound manner.
5. This writ petition is disposed of with observation that the petitioner may avail statutory remedy of filing election petition. In case election petition is filed within a period of one week from today, the same shall be considered and decided in accordance with law expeditiously.
