Heard Sri Rajesh Kumar Namdev, learned counsel for the petitioner and Sri Irshad Husain, learned Standing Counsel for the State-respondent nos.1 to 4.
By means of this writ petition, the petitioner has prayed to restrain the respondent no.5 from raising construction over the disputed land in Arazi No.131 area 0.1420 hectare situated in Village Chankmahi, Pargana Gopalapur, Tehsil Madhiyahun, District Jaunpur.
Disputed questions of fact are involved in the present writ petition, which cannot be adjudicated in the present writ petition. Further, the petitioner has filed two suits i.e. Suit No.T- 2011436687 of 2011 and Suit No.T-20181436060556 for partition and same are still pending.
The petitioner, if so advised, may pursue his remedy as available to him under the law before the appropriate forum.
We are not inclined to interfere in the matter. The writ petition is, accordingly, dismissed.
