1. The present petition is filed challenging the order dated 12.06.2012 issued by the Chief Conservator of Forest, Gandhinagar Circle transferring the petitioner from Dehgam Range to Meghraj Range.

Mehta, learned advocate appearing for the petitioner submitted that the petitioner was initially appointed on the post of Forester/Forest Extension Assistant on 20.03.1983 and since then he has been working on the said post. He submitted that during the service career the petitioner was transferred from one place to another place several times. Mr. Mehta has drawn the attention of this Court to the State Government Resolution dated 31.03.1989 providing guidelines for transfer of the Government employee wherein it is mentioned that a government employee should not be transferred before completion of three years and should not be kept at one place for more than five years.

Having heard learned advocates for the parties and having perused the papers on record, this Court is of the view that normally courts should not interfere in the matter of transfer as the same is a matter of administrative exigency. It is the discretion of the authorities concerned to regulate the service of the employee and to transfer particular employees as per the need of hour and demand of work. This court, therefore, does not wish to interfere in the matter of administration of the respondent authorities. The petitioner is required to resume duty at newly transferred place.
3.1 However, it is clarified that if any representation is made by the petitioner to accommodate his family by retaining the quarter, if any, the same shall be considered by the respondent authorities and allow the petitioner to retain the quarter if he so desires till the next academic year begins.
4. In the premises aforesaid, petition is dismissed.
