Heard learned counsel for the petitioner, learned counsel for the respondent, learned Standing Counsel and perused the record.
Learned counsel for the petitioner submitted that the petitioners are farmers. They have installed tubewell for irrigation purposes and electricity connection was taken by them. The petitioners were depositing the electricity dues time to time. However, due to bad weather and flood he suffered loss and as such the entire dues could not be deposited. Now there is pressure for deposit of the same and recovery certificate (annexure2 to the writ petitiion) has been issued and as such the petitioners are ready to deposit the same in easy instalments.
Learned counsel for the respondent no.3 submitted that since the electricity was consumed and it was not paid, hence the petitioners are not entitled for any relief. However, if they are ready to deposit the same within stipulated time, the respondents have no objection.
Considered the submissions.
In view of the above, if the petitioners deposit the electricity charges in six equal quarterly instalments, and first instalment is deposited by 30.4.2018 and thereafter five instalments in every quarter are deposited within time, the recovery certificate dated 4.12.2017 shall remain stayed. In case of default of any instalment, the authority concerned may take appropriate steps in accordance with law.
With the above observation this petition is finally disposed off.
